Abstract
شهد المـرفـق العـام للـكـهرباء بالجـزائري وفـرنسـا تحولات جديدة أدت به للإنفتاح عـلى المـنافـسة والّـذي إنعكس عـلى أساليب تدخّلالدّولة فـي القـطاع عبر إنتـهاج تقنية جديدة تـتناسب مع مـتطلبات المـنافـسة فـي القـطاع مـن جهة. ومـقتضيات المـرفـق العـام مـن جهة أخرى، تـعرف بالضّبط الاقتـصادي، الّتي تـعتـمد عـلى إستحـداث سـلطة ضبط قـطاعية مزوّدة بـوضائف مـتنـوعة تـمكنها مـن ضبط القـطاع، وتـقودها إلـى فـرض رقـابتـها السابقة واللاحقة عـلى سـوق الـكـهرباء، وهـذا فـي سبيل تحقيـق التـوازن بيـن وظـيفة الضّبط الاقتـصادي وفكرة المـرفـق العـام فـي قـطاع الـكـهرباء.
غـير أنه يلاحظ تغليب القـانـون الجـزائري والفـرنسـي لفكرة المـرفـق العـام فـي وظـيفة الضّبط الإقتـصادي للقـطاع، وهـذا مـن خلال تـعزيز وتحـديث المـبادئ الـكـلاسـيكية للمـرفـق وتدعيمها بتـمـويل عـمـومي. إلـى جانب إقـرار نظام إستثنائي يـتـم مـن خلاله إستبعـاد قواعـد المـنافـسة إذا كان مـن شأنها عرقلة أداء مهام المـرفـق. لذا يـتبيـن مـن التجربتين الجـزائرية والفـرنسـية حرصهمـا عـلى تقـديم مصـلحـة المـرفـق العـام للـكـهرباء عـلى حـساب قواعـد المـنافـسة فـي إطار وظـيفة الضّبط الإقتـصادي.
Le service public d’électricité, aussi bien en Algérie qu’en France, a connu de nouvelles mutations ayant conduit à son ouverture à la concurrence et, par conséquent, à la transformation des modalités d’intervention de l’Etat en la matière. Celle-ci s’est manifestée par l’adoption d’une nouvelle technique adaptée aux exigences de la concurrence et du service public. Il s’agit de la régulation économique, qui repose sur l’institution d’une autorité de régulation sectorielle dotée d’une multitude de pouvoirs lui permettant de réguler le secteur. Cela se traduit par l’exercice d’un contrôle en amont et en aval visant à concilier la fonction de régulation économique et l’idée de service public dans le secteur de l’électricité.
Cependant, force est de constater que les deux législateurs privilégient l’idée du service public dans la fonction de régulation économique du secteur, et ce, par le renforcement, la modernisation et le financement des principes classiques du service public. A cela s’ajoute la consécration d’un régime dérogatoire écartant l’application des règles de la concurrence lorsqu’elles sont de nature à entraver le bon fonctionnement du service public. Il ressort de l’expérience des deux législateurs en matière de régulation économique qu’ils sont soucieux de faire primer l’intérêt du service public d’électricité sur les règles de concurrence.
The public electricity service in both Algeria and France has undergone significant transformations, marked by a progressive shift toward market liberalization and competition. This evolution has directly influenced the mode of state intervention in the sector, prompting the adoption of a new regulatory approach designed to reconcile the imperatives of competition with the essential requirements of public service. This regulatory approach is embodied in the concept of economic regulation, which entails the establishment of a sector-specific regulatory authority vested with a broad range of functions. These include overseeing the sector, imposing both ex-ante and ex-post controls over the electricity market, and ultimately ensuring a balance between the objectives of economic regulation and the principles of public service within the electricity sector.
However, it is noteworthy that both Algerian and French legal systems have favored the public service rationale in the exercise of economic regulation. This preference is reflected in the reinforcement and modernization of classical public service principles, further supported by public funding mechanisms. Additionally, both systems have introduced exceptional legal regimes that allow for the exclusion of competition rules when such rules are deemed to hinder the performance of public service obligations.Accordingly, the Algerian and French experiences demonstrate a consistent commitment to prioritizing the public interest in electricity services over strict adherence to competition law, particularly within the framework of economic regulation.
