Abstract
تتناول هذه الدراسة موضوع "المنظمات غير الحكومية ذات الطابع الاقتصادي" باعتبارها فاعلا جديدًا ومؤثرًا في بيئة الاقتصاد الحديث، خصوصا في ظل تراجع أدوار الدولة التقليدية، وتنامي الحاجة إلى بدائل تنموية أكثر مرونة واستقلالا. تهدف الدراسة إلى تحليل الإطارين المفاهيمي والقانوني لهذه المنظمات، والتمييز بينها وبين غيرها من مكونات المجتمع المدني، كالأحزاب والنقابات، مع التوقف عند أبرز خصائصها ووظائفها.
كما تسلط الضوء على نماذج دولية رائدة، مثل الغرفة التجارية الدولية ومنظمة الشفافية الدولية، لتوضيح كيفية ممارسة هذه المنظمات لاختصاصاتها في الساحة الاقتصادية الدولية، ودورها في صياغة السياسات التجارية، وتسوية المنازعات، ودعم بيئة الأعمال. وقد خلصت الدراسة إلى أن هذه المنظمات تمثل ركيزة أساسية في منظومة التنمية المستدامة، لكنها لا تزال تواجه تحديات قانونية وتنظيمية في بعض السياقات، مما يستدعي إصلاحات تشريعية وهيكلية لتعزيز فاعليتها.
This study explores the topic of non-governmental organizations with an economic character, considering them as a new and influential actor in the modern economic landscape—particularly in light of the declining roles of traditional state functions and the growing need for more flexible and independent developmental alternatives. The study aims to analyze the conceptual and legal frameworks of these organizations and to distinguish them from other components of civil society, such as political parties and trade unions, while highlighting their main features and functions.
It also sheds light on leading international models, such as the International Chamber of Commerce (ICC), and the Transparency International (TI), to clarify how these organizations exercise their competencies in the global economic arena and their roles in shaping trade policies, resolving disputes, and supporting the business environment. The study concludes that these organizations form a fundamental pillar in the sustainable development framework, yet they still face legal and structural challenges in certain contexts, calling for legislative and institutional reforms to enhance their effectiveness.
