| dc.description.abstract | تعد العلامة التجارية المشهورة من أهم الأصول غير المادية الحديثة، ورغم غياب تعريف موحد فإن القوانين والاتفاقيات ركزت على معايير واقعية لقياس الشهرة، الحماية الدولية والوطنية تتكامل في ضمان عدم استغلال شهرة العلامة من قبل الغير ممَّا يعزز عدالة تجارية ويحمي المنافسة المشروعة، فالعلامة التجارية المشهورة تتعرض لمخاطر عديدة في الفضاء الالكتروني أبرزها التقليد، الاحتيال وللتصدي لهذه المخاطر يلزم تفعيل حماية قانونية و تكنولوجية متكاملة، إلى جانب دور الشركات والمنصات الرقمية في التصدي لهذه الانتهاكات، الرهان الحقيقي اليوم ليس فقط في حماية الاسم بل في حماية ثقة الجمهور. A well-known trademark is one of the most important modern intangible assets. Despite the lack of a unified definition, laws and agreements have focused on realistic standards for measuring fame. International and national protection complement each other to ensure that the brands fame is not exploited by third parties, which enhances commercial fairness and protects fair competition. A well-known trademark is exposed to numerous risks in cyberspace, most notably counterfeiting and fraud. To address these risks, comprehensive legal and technological protection must be implemented, alongside the role of companies and digital platforms in combating these violations. The real challenge today is not only in protecting the brand, but also in protecting public trust. | |
