| dc.description.abstract | للالتزام بالإعلام أهمية في مجال عقود الاستهلاك، فهو يشكل الحماية الحقيقية للمستهلك وذلك من خلال إعادة المساواة في العلم بين طرفي العقد، مما يتيح للمستهلك التعاقد بإرادة سليمة، لذا ألزم المشرع الجزائري المتدخل بإعلام المستهلك بخصائص المنتوجات وأسعارها وشروط البيع. يعتبر الالتزام بالإعلام أحد أهم الوسائل القانونية لحماية المستهلك كطرف ضعيف في العلاقة العقدية، فهو التزام عام يشمل جميع أنواع العقود، وقد أقر المشرع الجزائري قيام المسؤولية الجزائية والمدنية كأثر لإخلال المورد الإلكتروني بالتزامه بالإعلام. إضافة إلى الالتزام بالإعلام هناك حق العدول وهو مكنة قانونية أقرتها التشريعات من أجل توفير حماية قانونية للمستهلكين في مواجهة المتدخلين أصحاب الخبرات، حيث أن هذه المكنة توفر للمستهلك إمكانية الرجوع عن عقد قد تم إبرامه من خلال مهلة محددة. The obligation to inform is important in the field of consumer contracts, as it constitutes real protection for the consumer by restoring equality of knowledge between the two parties to the contract, which allows the consumer to contract with sound will. Therefore, the Algerian legislator obligated the intervener to inform the consumer of the characteristics of the products, their prices, and the terms of sale. The obligation to inform is considered one of the most important legal means to protect the consumer as a weak party in the contractual relationship. It is a general obligation that includes all types of contracts. The Algerian legislator has approved the establishment of criminal and civil liability as a result of the electronic supplier’s breach of his obligation to inform. In addition to the obligation to inform, there is the right of withdrawal, which is a legal mechanism approved by legislation in order to provide legal protection to consumers against experienced interveners, as this mechanism provides the consumer with the ability to withdraw from a contract that has been concluded within a specific period. | |
