| dc.description.abstract | يعتبر الحبس المؤقت إجراء من إجراءات التحقيق الذي يصدره قاضي التحقيق، إذ أن غايته هي تحقيق التوازن بين المصلحة العامة ومصلحة التحقيق المكفولة قانونا، إلا انه يشكل مساس بالحرية الفردية واعتداء على قرينة البراءة، الأمر الذي يستوجب تعويض المتهم الذي خضع لهذا الإجراء طالما أن الحبس المؤقت سلبه حريته وأبعده عن حياته الاجتماعية وعلى أعماله وسبب الأذى لسمعته وأسرته. وعلى هذا الشيء أقر المشرع الجزائري مبدأ التعويض عن الحبس المؤقت غير المبرر. وذلك بمنح تعويض مادي عن الأضرار التي لحقت بالمتهم. Temporary imprisonement is considered one of the investigative procedures issued by the investigating judge,as its purpose is toachieve a balance between the public interest and the interest of the investigation guaranteed by law.as it constitutes a violation of individual freedom and an assault on the presumption of innocence, which requires compensation for the individual how is incarcerated to this procedure as long as the temporary detention deprived him of this freedom, removed him from his social life and his employment, and caused harm to his reputation and his family. Accordingly, the Algerian legislator approved the principle of compensation for unjustified temporary imprisonment. by granting compensation for the damages suffered by the accused. | |
