| dc.description.abstract | تقوم مسؤولية المتدخّل على أساس المسؤولية الموضوعية وتحمّل التبعة، حيث أن المتدخّل لا يستطيع التخلص من المسؤولية لأنها لا تتعلق بخطئه الشخصي أو بخطأ من هم في حكمه، وإنّما مرتبطة بالنشاط ذاته، بالرغم من ذلك عملت الكثير من التشريعات على تحقيق قدر من التوازن في العلاقة بين المتدخّل والمستهلك، من أجل التخفيف من حدّة هذه المسؤولية، وذلك من خلال إعفاء المتدخّلين من تحمّل عواقب هذه المسؤولية إذا ارتبط الضرر الناشئ عن المنتوج المعيب بإحدى الأسباب العامة الموجبة للإعفاء، والمتمثلة في السبب الأجنبي، أو الخاصة المنصوص عليها في القوانين الخاصة بحماية المستهلك. The liability of the intervener is based on objective liability and bearing the consequences, as the intervener cannot escape liability because it is not related to his personal error or the error of those in his position, but rather is linked to the activity itself. Despite this, many legislations have worked to achieve a degree of balance in the relationship between the intervener and the consumer, in order to mitigate the severity of this liability, by exempting interveners from bearing the consequences of this liability if the damage resulting from the defective product is linked to one of the general reasons for exemption, represented by the foreign reason, or the special reason stipulated in the laws related to consumer protection. | |
