| dc.description.abstract | يعد المبعوثين الدبلوماسيين ممثلين رسميين لدولهم وحتى يؤدون مهامهم بكل حرية بعيدا عن أي ضغوطات ومضايقات اقتضت الضرورة الاعتراف لهم بجملة من الحصانات والامتيازات وعلى راسها الحصانة القضائية والجزائية وقد دعت الضرورة الى التعايش بين الدول مما فرض حتمية اقامة علاقات وتعاون عن طريق تبادل البعثات الدبلوماسية، ولكي يقوم هؤلاء الدبلوماسيين بواجباتهم ومهامهم بحرية بعيدا عن أي ضغوط او مضايقات في الدول المعتمدين لديها، كان من الضروري الاعتراف لهم بمجموعة من الامتيازات والضمانات والحصانات ومن اهمها الحصانة القضائية والجزائية من خلال قواعد قانونية واتفاقيات دولية تؤهل المبعوث الدبلوماسي لان يقوم بمهامه وما يؤكد ذلك اتفاقية فيينا للعالقات الدبلوماسية لسنة 1691 التي نصت على قواعد حمائية للمبعوث الدبلوماسي. Diplomaticenvoys are official representatives of their countries. In order for them to performtheirdutiesfreely, free fromany pressure or harassment, itisnecessary to recognize a number of immunities and privileges for them, mostnotablyjudicial and criminalimmunity. The need for coexistence among countries has necessitated the establishment of relations and cooperationthrough the exchange of diplomatic missions,It wasnecessary to recognize for them a set of privileges, guarantees, and immunities, the most important of whichisjudicial and penalimmunitythroughlegalrules and international agreementsthatqualify the diplomaticenvoy to carry out hisduties. This isconfirmed by the Vienna Convention on Diplomatic Relations of 1961, whichstipulated protective rules for the diplomaticenvoy. | |
