| dc.description.abstract | يمثل الإلتزام بالمطابقة أحد المفاهيم الأساسية والجوهرية في مجال حماية المستهلك،إذ يعد ركيزة أساسية وآلية قانونية تبناها المشرع الجزائري من خلال أحكام قانون حماية المستهلك وقمع الغش، وقانون الصحة لضمان المواد الإستهلاكية خاصة منها، الغذائية والصيدلانية المعروضة للتداول مستوفاة للإشتراطات القانونية بما يلبي الرغبات المشروعة للمستهلكين، التي من شأنها أن تجعل تلك المواد مطابقة للمواصفات والمقاييس و بضروروة إخاضعها لتقييم المطابقة. وفي سبيل تحقيق الهدف المنشود من الإلتزام بالمطابقة كرس المشرع مجموعة من المظاهر القانونية لتجسيد التطبيق الفعال له سواء من حيث توضيبه والملصقات والرقابة الصارمة، بغرض ضمان جودة المادة الغذائية والصيدلانية بما يضمن صحة وأمن المستهلك، وأكثر من ذلك أقر الجانب الردعي في حال إخلال المتدخل للإلتزام بالمطابقة سواء أكانت جزاءات إدارية تتخذ من قبل الأعوان المؤهلين لذلك، إلى جزاءا تجزائية المحددة في القانون رقم 09-03 (المعدل والمتمم )، وقوانين الصحة، بالإضافة للمسؤولية المدنية المستحدثة. Conformity is one of the basic and fundamental concepts in the field of consumer protection. It is a fundamental pillar and a legal mechanism adopted by the Algerian legislator through the provisions of the Consumer Protection and Suppression of Fraud Law and the Health Law to ensure that consumer items،especially food and pharmaceutical items offered for sale،meet the legal requirements to meet the legitimate desires of consumers،which would make these items conform to specifications and standards and must be subjected to conformity assessment. In order to achieve the desired goal of this obligation،the legislator has devoted a set of legal aspects to materialise its effective application،whether in terms of its clarification،labelling and strict control،in order to ensure the quality of food and pharmaceutical materials to ensure the health and security of the consumer،and moreover،the deterrent aspect has been established in case of violation of the obligation to conform،whether administrative penalties taken by qualified officers،to criminal sanctions specified in Law No. 09-03 (as amended and supplemented)،health laws،in addition to civil liability introduced in addition to the new civil liability. | |
