dc.description.abstractتلعب التكنولوجيا دورا متزايد الأهمية في مجال الإثبات الجنائي، حيث أصبحت الأدلة الرقمية والتقنيات الحديثة أدوات فعالة في كشف الجرائم وتحديد هوية الجناة بدقة، تشمل هذه الأدلة إلتقاط الصور والفيديوهات، التسجيلات الصوتية، إعتراض المراسلات، وكاميرات المراقبة، وتحليل الحمض النووي (DNA) ، والبيانات المستخرجة من الأجهزة الإلكترونية. بحيث تمكن هذه الوسائل القاضي من الوصول إلى اليقين القضائي وذلك من خلال تقديم معطيات دقيقة يصعب دحضها، مما يعزز مصداقية الإجراءات القضائية، كما أن التشريعات الحديثة بدأت تواكب هذا التطور لضمان حجية هذه الأدلة، مع مراعاة حقوق الأفراد وحماية خصوصيتهم، وفي المقابل، يظل للقاضي دور جوهري في تقدير قيمة هذه الأدلة وفقا لمبدأ حرية الإثبات وحدود الشرعية القانونية. بإختصار، ساهمت التكنولوجيا في تحديث آليات الإثبات الجنائي، مما رفع من فعالية العدالة الجنائية وساهم في تحقيق الردع والإنصاف. Technology plays an increasingly important role in the field of criminal evidence. Digital evidence and modern technologies have become effective tools for uncovering crimes and accurately identifying perpetrators. This evidence includes photographic and video recordings, audio recordings, intercepted correspondence, surveillance cameras, DNA analysis, and data extracted from electronic devices. These methods enable judges to achieve judicial certainty by providing accurate and difficult-to-rebut information, enhancing the credibility of judicial proceedings. Modern legislation has also begun to keep pace with this development to ensure the validity of this evidence, while respecting individual rights and protecting their privacy. Conversely, judges continue to play a fundamental role in assessing the value of this evidence in accordance with the principle of freedom of evidence and the limits of legal legitimacy. In short, technology has contributed to modernizing criminal evidence mechanisms, enhancing the effectiveness of criminal justice and contributing to deterrence and fairness.
