| dc.description.abstract | تتناول هذه المذكرة دراسة مبدأ سلطان الإرادة في ظل قانون المنافسة في التشريع الجزائري، في سياق التحولات الاقتصادية نحو النظام الليبرالي القائم على حرية المبادرة و المنافسة. فقد سعى المشرع الجزائري إلى تكريس حرية الصناعة و التجارة، غير أنه لم يتركها مطلقة، بل قيدها بضوابط قانونية لحماية النظام العام الاقتصادي و ضمان منافسة حرة و نزيهة. وتبرز الدراسة أن إطلاق حرية الإرادة قد يؤدي إلى ممارسات تضر بالسوق، مما استدعى حظر الاتفاقات المقيدة للمنافسة، و التعسف في وضعية الهيمنة أو التبعية الاقتصادية، وبعض الممارسات السعرية التعسفية، مع التمييز بين حظر مطلق وآخر نسبي قابل للترخيص. كما تناولت دور مجلس المنافسة كسلطة إدارية مكلفة بضبط السوق، رغم ما يواجهه من تحديات تتعلق باستقلاليته ونقص التكوين، مما يؤثر على فعاليته، ويستدعي تعزيز دورها التحسيسي وضمان استقلاله. This thesis examines the principle of autonomy of will within the framework of competition law in Algerian legislation, in light of the shift toward a liberal economic system based on freedom of initiative and competition. While the Algerian legislator has sought to guarantee freedom of industry and trade, it has not left it unrestricted, but rather subjected it to legal controls to protect the economic public order and ensure fair and free competition. The study highlights that absolute contractual freedom may lead to practices harmful to the market, which justifies the prohibition of anti-competitive agreements, abuse of dominant position, abuse of economic dependence, and certain unfair pricing practices, while distinguishing between absolute and relative prohibitions. It also addresses the role of the Competition Council as an administrative authority responsible for market regulation, despite challenges related to its independence and the limited specialization of its members, which affect its effectiveness and call for strengthening its awareness-raising role and ensuring greater autonomy. | |
