| dc.description.abstract | يهدف المشتري أو المستهلك عند شرائه المنتوج للإنتفاع به بشكل كامل وآمن لأطول فترة ممكنة لتحقيق الغرض المرجو منه، ويعتبر الإلتزام بالصيانة من أكثر الوسائل الفعالة لتحقيق رضا المشتري أو المستهلك إذا حدث خلل أو عيب في الشيء المبيع يلزم البائع أو المنتج بصيانته وإصلاحه، مما دفع التجار والبائعين إلى إدراج هذا الالتزام ضمن عقد البيع أو ضمن وثيقة ملحقة لهذا العقد تسمى شهادة الضمان. يرد الإلتزام بالصيانة في عقد البيع وبالتالي فهو التزام عقدي يخضع لإرادة المتعاقدين، ويعتبر صورة من صور الضمان الإتفاقي يتفق فيه الأطراف على إلزام البائع بإصلاح وصيانة الشيء المبيع طوال مدة الضمان إذا طرأ عليه خلل أو عيب مصنعي، وعليه فهو يخضع للقواعد العامة في الإلتزامات التعاقدية المنصوص عليها في القانون المدني. The buyer or consumer, when purchasing the product, aims to have full and safe access to it for as long as possible in order to achieve its intended purpose. The obligation to maintain is considered one of the most effective means of achieving the buyer's or consumer's satisfaction if there is a defect or defect in the object sold that the seller or producer is obliged to maintain and repair, prompting traders and sellers to include this obligation in the sales contract or in a document attached to this contract called a certificate warranty. The maintenance obligation is set forth in the sales contract and is therefore a contractual obligation subject to the will of the contractors.
