| dc.description.abstract | يُعتبر العقـار أهم ملك يسعى كل شخص الحصول عليه ويشكل العقـار العمومـي أبرز هذه العقـارات بحكم طبيعتها القانـونية التي جعلت منه مجالا خصبا للاستثمـار والاحتيال، لذا بات من الضروري على الدولة البحث عن سبل لحمايته والمحافظة عليه والانتفاع بمكاسبه من جهة وجعله آلية لجذب الاستثمـار من خلال خلق بيئة ومحيط قانـوني ملائم من جهة أخرى، وهو ما عمدت الدولة على تكريسه عن طريق اعتماد مقاربة اقتصادية جديدة تشمل في جوهرها أهم مبادئ الحوكمة كالشفافية، المشاركة، الرقابة والمسائلة، مُحَاوِلةً منها لتوسيع نطاق تطبيق هذه الأخيرة وترشيد استغلال العقـار العمومـي المخصـص للاستثمـار. La propriété immobilière est considérée comme le bien le plus important que chacun cherche à acquérir, le domaine immobilier public est le plus immanent en raison de sa nature juridique, ce qui a fait de lui un terrain fertile pour l'investissement et la fraude. Il est donc devenu nécessaire pour l'état de chercher les moyens pour le protéger et le préserver ainsi que de tirer profit de ses avantages d’un cote. Et en le rendant attractif pour les investissements en créant un environnement juridique et administratif approprié d’un autre cote. C'est ce que l'état a entrepris en adoptant une nouvelle approche économique, qui incorpore principalement les fondements essentiels de la gouvernance tels que la transparence, la participation, le contrôle et la responsabilisation, dans le but d'étendre l'application de ces principes et de rationaliser l'utilisation des biens immobiliers publics destinés à l'investissement. The real estate is considered the most important asset that everyone tries to acquire. Public real estate is the most prominent among these properties due to its legal nature, making it a fertile ground for investment and fraud. Therefore, it has become necessary for the state to find ways to protect and preserve it, benefit from its gains in one hand, and make it a tool to attract investment by creating an appropriate legal and administrative environment in the other hand. This is what the state has targeted to achieve by adopting a new economic approach, which incorporates key governance principles such as transparency, participation, control, and accountability, in order to expand the application of these principles and rationalize the use of public real estate designated for investment. | |
