| dc.description.abstract | ظهر مبدأ حسن النية للتخفيف صرامة بعض النصوص القانونية التي قد يؤدي تطبيقها إلى مخالفة روح العدالة وجوهرها، ويعتبر من المبادئ الأساسية التي تم تكريسها في القوانين سواء العامة أو الخاصة، وذلك نظرا للدور الفعال الذي يلعبه في علاقة الأطراف المتعاقدة، ويعد من أحد الوسائل التي يستخدمها المشرع والقاضي لإدخال القاعدة القانونية في العلاقة القائمة بين الطرفين، مما جعل المشرع الجزائري يبدي إهتماما لهذا المبدأ وذلك ما أدى لتكريسه في القانون المدني وغيره من التشريعات الحديثة. The principle of good faith has emerged to reduce the severity of certain legal provisions, the application of which may violate the spirit and essence of justice. It is one of the fundamental principles dedicated in both public and private law, given the active role it plays in the relationship between the contracting parties. It is one of the means used by the legislature and the judge to introduce legal rules into the relationship between the two parties. This has led the Algerian legislature to show interest in this principle, as a result of which has been dedicated in the Civil Code and other modern legislation. | |
