| dc.description.abstract | ساهمت عمليات نقل وزرع الأعضاء البشرية في إنقاذ المرضى المهددة حياتهم بالموت المؤكد، بعدما فشلت العلاجات التقليدية في علاجهم، ونظرا لأهمية وخطورة هذه التدخلات على جسم الإنسان وأعضائه، فقد عمد المشرع الجزائري إلى تقييدها بمجموعة من الضوابط القانونية، حماية لأطرافها، خصوصا المتبرع كونه الطرف الوحيد الذي لا يستفيد من هذه العمليات. إن مخالفة الجراح للضوابط التي تحكم ممارسة نقل وزرع الأعضاء البشرية بين الأحياء أو من الجثث، يشكل تصرفا غير مشروع في الأعضاء البشرية، وهو ما يؤدي حتما إلى قيام مسؤوليته سواء الجزائية أو المدنية. Organ transplantation has contributed to saving the lives of patients who were facing imminent death after traditional medical treatments failed. Given the seriousness and importance of such interventions on the human body and its organs, the Algerian legislator has subjected them to a set of strict legal controls in order to protect all parties involved, particularly the donor, who is the only party that does not directly benefit from these operations. Any surgeon who violates the rules governing the removal and transplantation of human organs, whether between living persons or from deceased individuals, commits an unlawful act involving human organs, which inevitably gives rise to liability, whether criminal or civil. | |
