Abstract
يعد القانون 11-04 قفزة نوعية في مجال السكن و العمران في الجزائر، و الذي عمل المشرع على تكريسه متجاوزا بذلك النقائص التي شابت القوانين السابقة من خلال جعله ضمانة لحماية المقتنين.
نظم بموجب هذا القانون نشاط الترقية العقارية جاعلا منه مهنة تمارس من طرف أشخاص يتمتعون بمؤهلات شخصية و مالية أيضا، وأخضعه لمراقبة هيئات خاصة.
كما نظم عقود الترقية العقارية من خلال ضبط مفهومها و الالتزامات و الضمانات المنبثقة منها، كما شدد المشرع من حيث توقيع الجزاءات على كل مرقي عقاري يرتكب تجاوزات تجاه المهنة نفسها أو تجاه المقتنين.
بالتالي صدور هذا القانون كان ضروري لحماية الطرف الضعيف في الحلقة التعاقدية و هذا من خلال تدخل المشرع و إظهار الالتزامات المقررة لحماية المقتني و أيضا إظهار الجزاءات التي توقع على كل من يخالف الأحكام المنصوص عليها في القانون 11-04 المحدد لقواعد التي تنظم نشاط الترقية العقارية .
In algeria, the legislation of 11-04 is considered as a major break through in the field of housing and urbanization ,the legislation devotes the admix imperfections in the previews laws , through makes it a warranty to protect the possessors .
by virtue of law ,a real estate promotional activity was organized as a profession practiced by persons who have personal and financial qualifications as well, furthermore are controlled by private entities .
moreover, it organized a real estate promotional acts through readjusts its conceptual, liabilities and the emerged guaranties, as the legislator persist on signing sanctions on every real estate developer who commits contraventions towards the profession itself or towards the possessors .
therefore, promulgate this law was a necessity to protect the doubtful party in the act section which is by the legislator interference and reveals the decided liabilities to protect the possessor and shows the sanction fallen over the transgress the prescribed judgments on the legislation of 11-04 appointee to regulations which organized the activity of real estate promotion .
