dc.description.abstractتُعدّ الحاجة لإغاثة الأشخاص المتضرّرين من النزاعات المسلّحة والكوارث الطبيعية من بين الالتزامات التي تفرض على المجتمع الدولي واجب تقديم المساعدة، وهو الالتزام الذي يقابله من جهة أخرى حق الضحايا في الحصول على المساعدات الإنسانية. يُشكّل وصول موارد الغوث للسكان الذين هم في أمسّ الحاجة إليها في أحسن الظروف تحدّيا للمنظمات غير الحكومية بسبب عدّة عراقيل عملية ترتبط أساسا ببطء الإجراءات الإدارية، الحرمان التعسّفي من وصول المساعدات الإنسانية للضحايا من قبل أطراف النزاع، وانعدام سلامة موظّفي المنظمات الإنسانية. وعلى هذا الأساس، أصبح تنفيذ العمل الإنساني يرتبط أشد الارتباط باستخدام القوة المسلّحة المرخّصة من طرف مجلس الأمن في إطار الفصل السابع من ميثاق هيئة الأمم المتحدة، حيث يعتبر المجلس أنّ فعل عرقلة وصول المساعدة إلى الضحايا، يُشكّل تهديدا للسلم والأمن الدوليين بالمعنى الوارد ذكره في نص المادة 39 من الميثاق. Sammary : The need to help and assist people affected by armed conflict and natural disasters becoms an imperative that can’t be evaded. As a result, the international community has a duty to assist or, for victims, a right to humanitarian aid. Humanitarian access to people in need of assistance is often a challenge for NGOs because of practical obstacles related to the frequent slowness of administrative procedures, the arbitary refusal to channel humanitarian aid by parties to armed conflict, and the insecurity of the staff of humanitarian organizations. As a result, humanitarian action was covered by the use of force authorized by the Security Council under Chapter VII of the United Nations Charter, which the council considered as obstructing the delivery of aid constitutes a threat to international peace and security within the meaning of Article 39 of the Charter.en
