| dc.description.abstract | استحوذت مسألة الشرعية الدولية على اهتمام الفقه و القضاء الدوليين منذ نهاية الحرب العالمية الثانية، و لم يكن ذلك إلا عارضا من عوارض الأزمة العميقة التي كان و لا يزال يتخبط فيها القانون الدولي، و في نفس الوقت انعكاسا لأزمة هوية المجتمع الدولي التي يمكن مردها في غياب عنصر الثبات فيما يدافع عنه أعضائه من قيم اتسمت بالتغير المستمر في طبيعتها المرتبط بشكل رئيسي بتطور الأطماع الشخصية لفئة محدودة من .الدول المهيمنة على الساحة الدولية تجسدت هذه الأزمة على أرض الواقع في السهولة الغير معهودة التي تمكنت في سياقها الولايات المتحدة الأمريكية فرض قراءتها الخاصة لقواعد القانون الدولي للتدخل عسكريا في العراق عام 2003، و إخضاع شعبه لنظام استبدادي قوامه الظلم و الجور اقترفتهما تحت مظلة "احتلال إنساني" ، لا يقيدها إلا هي و حلفائها La question de la légitimité internationale c'est accaparée l'intérêt de la doctrine et la justice internationales dés la fin de la deuxième guerre mondiale, et cela ne constitua qu'un symptôme d'une crise profonde dont souffre le droit international. En même temps cela n'a été qu'une réflexion d'une crise identitaire de la communauté internationale dont la source émane de l'absence de facteur de stabilité dans les valeurs défendu par ses représentants. Valeurs qui se caractérisent par un changement constant en relation avec l'évolution continue des intérêts personnels d'une caste réduite d'Etats influents sur la scène internationale. Cette crise c'est cristallisée sur le terrain par une facilité déconcertante avec laquelle les Etats-Unis d'Amérique ont pu imposé leur lecture personnelle des règles de droit international pour justifier leur intervention militaire de 2003 en Irak, et obliger le peuple irakien à vivre dans le cadre d'un système injuste sous le couvert d'une occupation humanitaire dont elle est seule soumise avec ses alliés. The question of international legitimacy has monopolized the attention of the international doctrine and justice since the end of World War II, and this constituted a symptom of a deep crisis plaguing the international law. At the same time the crisis was a reflection of an identity crisis of the international community whose source comes from the lack of stability factor in the values defended by its representatives. Values that are characterized by a constant change in relation to the continuing evolution of the personal interests of a small caste of influential states in the international arena. This crisis is crystallized on the ground in a disconcerting ease with which the United States of America have imposed their personal reading of the rules of international law to justify the 2003 military intervention in Iraq and compel the Iraqi people to live as part of an unfair system under the guise of humanitarian occupation which it’s the sole subject with its allies. | en |
