شايب يوبا2025-09-222025-09-222025-06-27https://dspace.ummto.dz/handle/ummto/2800973 p.; (+CD)إنّ الغرر معناه الخطر والهلاك ولهذا حرمه الشرع وتهدف هذه الدراسة إلى تحليل النصوص القانونية المتعلقة بعقود الغرر في القانون المدني الجزائري وقد توصلت الدراسة إلى عدة نتائج ومنها أن الشريعة الإسلامية وضعة عدة ضوابط لتحريم عقود الغرر كأن يكون الغرر قد وقع في العقد الأصلي، وأن تكون نسبة الغرر كبيرة جدًا كما أنّ المشرع الجزائري وضح المقصود بعقود الغرر في القانون المدني الجزائري بذكر أمثلة عن عقود الغرر، في عقد التأمين وعقد المقامرة والرهان والراتب مدى الحياة. The uncertainty means danger and destruction that is why the law forbids it. This study aims to analyze the legal texts related to uncertainty contracts in Algerian civil law. The study reached several results including that Islamic law has established several controls to prohibit ambiguity contracts. Such as if the uncertainty occurred in the original contract and the percentage of the uncertainty was very large. Also, the Algerian legislators clarify what is meant by Laura contract.
