Abstract
يظهر تأثير الإدارة على الضمانات الإدارية للموظف العام في الجزائر من خلال تواجدها في كل الجوانب المشكلة للنظام التأديبي للوظيفة العمومية، انطلاقا من هيمنتها على سن القاعدة القانونية ومرحلة تكييفها مرورا ببسط تحكمها على مسار الإجراءات التأديبية وصولا لإمتناعها عن تنفيذ الأحكام القضائية الصادرة في مواجهتها.
إن مجال التأثير الواسع للإدارة بسلطتها التأديبية على الموظف العام يجرد الضمانات والحماية من محتواها، الواقع الذي يستدعي إعادة النظر فيه، بتخصيص قانون مستقل للتأديب الإداري يفعل أكثر الضمانات التأديبية للموظف العام بما يقرر له الحماية والعدالة التاديبية التي تحفظ حقوقه الوظيفية.
En Algérie, l'influence de l'administration sur les garanties administratives du fonctionnaire public
apparaît à travers son omniprésence dans tout le système disciplinaire de la fonction publique. C’est, en
effet, l’administration qui exerce sa domination ou contrôle complet sur la promulgation de la règle
juridique et qui, de plus, l’adapte en étendant son contrôle sur le déroulement des procédures
disciplinaires, jusqu'à sa non-exécution des décisions judiciaires rendues à son encontre.
L'administration, qui jouit de cette autorité disciplinaire sur le fonctionnaire public, pèse de toute
sont influence jusqu’à faire abstraction des notions de garantie et de protection. Ce qui requiert la
révision du système disciplinaire en consacrant une loi indépendante pour le régime disciplinnaire qui
assurera, au fonctionnaire public, plus de garanties disciplinaires , de la protection et concrétiser la justice
disciplinaire qui puisse garantir et préserver ses droits professionnels.
The impact of the disciplinary authority in Algeria reflects (shows) on the public servants'
guarantees through its spread to every aspect that constitutes the disciplinary system of the public
service( office). Starting with it's dominance on the creation of the legal foundation ( bases ,standards) and
it's adjustment phase ,moving to exercing it's control upon the disciplinary process ,to finally opposing to
applying any legal verdicts that oppose it.
The large scale impact of the administration with it's disciplinary authority on civil (public) servants
is stripping off the guarantees and protection from it's content .This calls to its reconsideration by
eddicting an independent law of administrative disciplining that activates more the civil servant's
disciplinary guarantees with what ensures his protection and disciplinary justice that preserves his job's
right.
