Abstract
تتعرض البيئة العالمية اليوم لعملية تدمير واسعة ومستمرة ومن أهم أسبابها النزاعات المسلحة، حيث أن العالم شهد تطوّرا تكنولوجي في مجال صناعة أسلحة الدمار الشامل فزادت حدتها وتنوعت أساليبها، الأمر الذي أدى إلى تكاتف الجهود الدولية لتفادي التجاوزات التي تطرأ على البيئة في هذه الأوقات، وتجسدت هذه الجهود في تطوير أحكام وقواعد القانون الدولي الإنساني المعنية بحماية البيئة أثناء النزاعات المسلحة، من خلال إبرام العديد من الاتفاقيات والبروتوكولات الملحقة بها وإصدار القرارات من الأجهزة التي تعنى بهذه الحماية، وعلى الرغم من أن هذا القانون يحظر استخدام القوة المسلحة ضد البيئة إلا أن هذه الظاهرة قائمة ومستمرة كأداة في السياسات الخارجية والداخلية للدول.

Ces efforts se sont reflétés dans l’élaboration des dispositions et des règles du droit international humanitaire de protection de l’environnement pendant Les conflits armés, et aussi par la conclusion de plusieurs conventions et protocoles y afférents et par l’émission de résolutions des organes chargés de cette protection, Malgré que cette loi interdit le recours à la force armés contre l’environnement, mais ce phénomène existe et continue d’être un instrument utilisé par les états dans leur Politique intérieure et étrangère.
