Abstract
نظرا للتداخل الحاصل في المفاهيم التي أصبحت اليوم متقاربة بين كل من حق اللجوء الإقليمي والهجرة بنوعيها الشرعية وغير الشرعية وكذلك الإرهاب وغيرها من جهة، وأمام ظهور مواجهات عديدة وواسعة النطاق لتلك المفاهيم والسياسات المنتهجة من طرف مختلف دول العالم حيال ذلك من جهة أخرى، بات من الضروري البحث عن المفهوم المعتمد لحق اللجوء الإقليمي وحدود الأسس التي يعتمد عليها تبعا لوجود ترابط بين القواعد الداخلية والمبادئ الدولية المنظمة لذلك الحق.
فعليه يكون التساؤل المطروح هو مدى وجود تجانس بين تلك القواعد الداخلية من جانب والقواعد الدولية المنظمة لحق اللجوء الإقليمي من جانب آخر؟
وهل هناك تطابق بين الإجراءات المعتمدة في التشريعات الداخلية للدول وتلك المتخذة في إطار النصوص الدولية المتضمنة لهذا الحق؟
وأخيرا هل تعتبر معاملة اللاجئين وما يترتب عن اللجوء الإقليمي متطابق مع نصوص الاتفاقية الدولية المعنية به ؟
Given the overlap in the concepts that have become close today, between the right to territorial asylum and both legal and illegal immigration, as well as terrorism and others. And in view of the emergence of numerous and widespread confrontations with respect to those concepts. And policies adopted by the various States of the world. It has become necessary to look for the concept of territorial asylum and the limits of the grounds on which it is based. Depending on the correlation between internal rules and the international principles governing that right.
The question must be whether there is homogeneity between those internal rules on the one hand and the international rules governing regional asylum on the other side.
Are the procedures adopted in States' domestic legislation compatible with those taken within the framework of international texts incorporating this right?
Finally, is the treatment of refugees and what results from regional asylum compatible with the provisions of the relevant international convention?
