Abstract
الملخص بالعربية :
-شهدت الجزائر كغيرها من الدول التي عرفت الإسلام نظام الوقف منذ فترات مبكرة ، إلا أنه بلغ ذروة تطوره خلال العهد العثماني ، فبقدومهم تعززت الحياة الدينية و إرتقى نظام الوقف ليصبح ضمن إطار مؤسسات مختلفة التوجه المذهبي و الوظيفي ، و من بين أشهر هذه المؤسسات ، برزت مؤسسة وقفية جاء تأسيسها مصاحبا للوجود العثماني في الجزائر و هي :
-"مؤسسة سبل الخيرات " هي مؤسسة وقفية حنفية خيرية تتواجد بمدينة الجزائر ، جاء تأسيسها بقرار من الأوجاق الإنكشارية سنة 1584م،خضعت لسياسة تنظيمية و مالية محكمة ، و يعتبر جوهر تأسيسها هو خدمة ورعاية المؤسسات القائمة على المذهب الحنفي من مساجد ، زوايا و كتاتيب .
-ساهمت مختلف الفئات المشكلة لمجتمع مدينة الجزائر في الوقف لصالحها ؛ من حكام عثمانيين ، جنود ، موظفين سامين و حتى الحضر بمختلف فئاتهم من حرفيين ، تجار ، أشراف و النساء أيضا و منهن المعتقات ، و قد إستفادت هذه المؤسسة من عدد معتبر من الوقفيات بمختلف أنواعها من عقارات و أموال ، منها ما إستفادت منه المؤسسة بشكل مباشر و منها ما كان غير مباشر و مستثمرا في المؤسسات التي تشرف عليها ، أخضعت هذه المؤسسة وقفياتها لمعاملات مشروعة مكنتها من ضمان و مضاعفة مدها الوقفي ، و نظرا لشعبيتها و المكانة التي إكتسبتها تمكنت من المشاركة في طبع الحياة الإقتصادية ، الإجتماعية و الثقافية لمدينة الجزائر .
- جسدت هذه المؤسسة التعايش المذهبي بين المالكية و الأحناف ، و نزعة الخير لدى الحكام العثمانيين و المحكومين سكان البلد و الأهم أنها أظهرت مستوى فاعلية مؤسسات الوقف و تطورها بالجزئر خلال العهد العثماني .

Algeria ,and other countries that know Islam, witnessed the waqf system from early periods, but it reached the peak of its development during the Ottoman era, with the arrival of the Ottomans religious life was strengthened , and the waqf system advanced to become a framework of institutions with different sectarian and functional orientations,and the most famous of these institutions that emerged was a waqf institution whos established accompanied the Ottoman presence in Algeria which is :
The "Sabil Al Khairat Fondation " is a charitabele Hanafi waqf foundation located in Algiers ,it was established by a decision of the Janissary chiefs in 1584 AD,its organizational and financiel policy was strictly regulated , and the essence of its establishment was to serve and care for institutions based on the Hanafi school of thought,such as mosques , zawiyas ,and kuttabs .
Various segments of Algiers society contributed to the waqf on its behalf ,including Ottoman rulers , soldiers ,senior officals ,and even urbanites of all classes , including craftsmen,merchants ,nobls , and women,including freed slaves , this foundation benefited from a significant number of waqfs of vaious types , including real estate and funds , some of which benefited the foundation directly , while others were indirectly invested in the institutions it supervised , This foundation subjected its waqfs to legitimate procedures that inabled it to guarantee and double its endowments, Due to its popularity and the status it acquired , it was able to participat in shaping the economic ,social and cultural life of Algiers.
The institution embodied the sectarian coexistence between the Maliki and Hanafi schools , the benevolent tendency of the Ottoman rulers and the ruled and most importantly , it demonstrated the level of effectiveness of endowment institutions and their development in Algeria during the Ottoman era .
