Abstract
اللجنة الوطنية لمنح علامة “مؤسسة ناشئة” و”حاضنة أعمال” تابعة لوزير اقتصاد المعرفة والمؤسسات الناشئة، أُنشئت بموجب المرسوم التنفيذي رقم 20-254 المؤرخ في 15 سبتمبر 2020. تهدف إلى تحديد الإطار القانوني والتنظيمي للمؤسسات المبتكرة والحاضنات، وتمييزها عن باقي الكيانات الاقتصادية التقليدية من خلال منح علامة رسمية تُتيح لها الاستفادة من نظام قانوني خاص وحوافز مالية وجبائية وإدارية. تُعالج طلبات منح العلامة عبر المنصة الرقمية “Startup Algeria”، بعد دراستها وتقييمها من طرف اللجنة التي تضم ممثلين عن مختلف الوزارات (المالية، التعليم العالي، الصناعة، الرقمنة...) وخبراء في مجالات الابتكار والتكنولوجيات الحديثة. يتمّ التقييم وفق معايير دقيقة تتعلق بدرجة الابتكار، القيمة المضافة الاقتصادية، الجدوى التقنية، والاستقلالية القانونية للمؤسسة. تمنح العلامة للمؤسسات والمشاريع التي تستوفي الشروط القانونية والتنظيمية، مما يسمح لها بالاندماج في منظومة الابتكار الوطني والاستفادة من الدعم العمومي وبرامج المرافقة. تُعد هذه اللجنة أداة قانونية أساسية لترقية ريادة الأعمال وتطوير الاقتصاد القائم على المعرفة في الجزائر، غير أن فعاليتها تظل مرتبطة بتعزيز استقلالها وضمان الشفافية في عملها والتنسيق بين مختلف المتدخلين.
The National Committee for the Granting of the “Startup” and “Business Incubator” Label operates under the supervision of the Minister of Knowledge Economy and Startups. It was established by Executive Decree No. 20-254 of September 15, 2020. This committee aims to provide a legal and administrative framework for innovative enterprises and incubators by granting them an official label that allows them to benefit from a special regime including fiscal, financial, and administrative incentives. Applications for the label are submitted and processed through the digital platform “Startup Algeria”. They are examined by the committee, which is composed of representatives from various ministries (Finance, Higher Education, Industry, Digital Economy, etc.) and experts in innovation and technology. The evaluation is based on specific criteria such as the level of innovation, economic added value, technical feasibility, and legal independence of the enterprise. The label is granted to companies and projects that meet the required legal and regulatory conditions, allowing them to integrate into the national innovation ecosystem and benefit from public support and incubation programs. This committee represents a key legal instrument for promoting entrepreneurship and the development of the knowledge-based economy in Algeria, while its effectiveness depends on greater independence, transparency, and coordination among stakeholders.
