Abstract
يولي المشرع الجزائري أهمية كبيرة للعقارات ويبذل جهوداً لتنظيم الجرائم المرتكبة ضدها، مما أدى إلى وضع مجموعة متنوعة من النصوص القانونية في قانون العقوبات والقوانين الخاصة بهدف حماية الملكية العقارية بكافة أشكالها، و في حالة حدوث اعتداء على العقارات وانتهاك القوانين المنظمة لها، توفر القوانين وسائل لحماية هذه الحقوق، بما في ذلك اللجوء إلى الدعاوى القضائية. هذه الدعاوى تهدف إلى تأكيد الحقوق المتضررة وتحقيق العدالة، حيث يمكن لأصحاب الملكية المتضررين من الجرائم العقارية أن يلجأوا إلى القضاء للحصول على حماية وتنفيذ القوانين المعنية.
The Algerian legislator attaches great importance to real estate and makes efforts to regulate crimes committed against it. This has led to the establishment of various legal texts within the Penal Code and specific laws aimed at protecting property rights in all its forms. In cases of assault on properties and violations of the laws regulating them, these laws provide means to protect these rights, including resorting to judicial proceedings. These lawsuits aim to affirm the rights of the affected parties and achieve justice, allowing property owners harmed by real estate crimes to seek judicial protection and enforcement of relevant laws.
