Abstract
شكل تنظيم استخدام وسائل القتال في النزاعات المسلحة مسألة محورية لمسعى الحماية الذي يقوم عليه القانون الدولي الإنساني، لهذا الغرض وُضع نظام قانوني للحظر والتقييد حسب طبيعة وآثار كل سلاح.
وبينما تُبذل جهود كثيرة لمجاراة المستجدات التقنية لميدان التسلح وضبطها ،يكشف الواقع عن ممارسات تؤسس لانتهاكات جسيمة متكررة للقواعد القانونية السارية.
يبقى استعمال الأسلحة يمثل إشكالية قانونية وإنسانية قائمة تهدد أمن الأشخاص والمجتمعات، لتكون بذلك إحدى تحديات المسعى العالمي الجديد الذي يرتكز على الحرية، أي تحرير الإنسان من الخوف والحاجة،باعتباره ملخص للأمن الإنساني كغاية
La réglementation de l'utilisation des moyens de guerre durant les conflits armés représente un enjeu central pour l’objectif de protection qui sous-tend le droit international humanitaire.À cet effet, un régime d'interdictions et de restrictions a été établi selon la nature et les effets de chaque arme.
Alors que, de nombreux efforts sont déployés pour rivaliser les évolutions techniques du domaine d’armements et parvenir à leurs contrôles, la réalité du terrain révèle des pratiques établissant des violations graves et répétées des règles juridiques en vigueur.
L'emploi des armes reste un problème juridique et humanitaire menaçant la sécurité des individus et des sociétés, ce qui en fait l’un des défis du nouvel objectif mondial qui se fonde sur la liberté, c’est-à-dire, la libération de l’homme de la peur et du besoin comme résumé de la sécurité humaine en tant qu’une fin.
Regulating the use of means of warfare in armed conflicts constituted a pivotal issue for the protection quest that underpins the international humanitarian law, for this purpose, a legal regimeof prohibition and restriction has established according to the nature and the effects of each weapon.
While many efforts have beenmaking to keep pace with technical developments in the field of armaments and to reach their constraint, the reality reveals practices that establish repeated grave violations of the existing rules in force.
The use of weapons remains a legal and humanitarian problem that threatens the security of individuals and societies, that to be one of the challenges of the new global endeavour based on freedom, i.e. liberating human beings from fear and need such as a summary of human security as an end.
