Abstract
و نستنج من خلال دراستنا لموضوع أحكام البيع بالتقسيط في نشاط الترقية العقارية أنه آلية قانونية كرسها المشرع الجزائري من أجل الحصول على السكن حيث إهتم به إهتماما بليغا خاصة في مجال العقارات، وفي ظل إنحفاض القدرة الشرائية للفرد من جهة وأزمة السكن من جهة أخرى.
وعلى هذا الأساس لجأ الفرد إليه بإعتباره الوسيلة الوحيدة التي تمكنه من تقسيط الثمن عبر دفعات تتماشى مع قدرته المالية، وقد يأخذ البيع بالتقسيط في نشاط الترقية العقارية عدة صور منها في ظل قانون 11-04 أي البيع على التصاميم وعقد حفظ الحق، وصورة التنازل عن الأملاك الخاصة بالدولة.
فقد لجأ المشرع الجزائري الى تنويع من هذه الصور من أجل مراعاة الإختلاف الفئات الاجتماعية.
Through our study of the issue installment sales provisions in real estate promotion activity ؛
We conclude thate it is considered a legl mechanism established by the Algerian legislator in order to obtain housing؛ as he paid great attention to it especially in field of real estate and in light of the decline in the one hand and the housing crisis on the other hand.
On this basis the individual resorted to it as the only means that enables him to pay the price in installments through payments consistent with his financial ability؛ installments sales in real estate promotion activity may take several form؛ including in light of law 11-04 sales based on designs a contract to preserve the right؛ and a form of assignment of private property in the country
The Algerian legislator only resorted to diversifying these images in order to take into account the differences in social groups.
