Abstract
الضبطية القضائية هي الصلاحية الممنوحة لبعض الأشخاص بموجب القانون لاتخاذ إجراءات التحقيق و جمع الأدلة بشأن الجرائم .ومع ذالك ، ترد على هذه القاعدة استثناءات تحد من صلاحيات مأموري الضبط القضائي في بعض الحالات لحماية الحقوق و الحريات أو تنظيم الإجراءات .
قانون 22-06 المعدل و المتمم ضمن أساليب حديثة سعيا من المشرع الجزائي إلي تحقيق نوع من التوازن في المجتمع بين الجزاء و محاربة الجريمة فهنا تكمن أهمية هذا الموضوع خاصة من الناحية العملية ، حيث يتيح لأفراد الضبطية الممارسة الفعالة مع سرعة التنفيذ و توفير نوع الحماية في بغض المهام المنوط لضبطية القضائية .
كما لم نخلو القوانين الخاصة، قانون مكافحة الفساد و الوقاية منه و كذا قانون التهريب ما يتيح مجال حيوي للعمل سواء من ناحية الإجراءات آو الضمانات الواردة لحماية حقوق و حريات الأشخاص داخل المجتمع.
Judicial police authority is the power granted to certain individuals by Law to teke investigatrice masures and collet évidence concerning crimes. However this general rule is subject to exceptions that limit the powers of judicial police officers in certain cases either to protect rights and freedoms or to regulate procedures.
Law 06-22 as amended and included within modern legal text aims to achieve a balance between society’s need for justice and the fight against crime .hence the importance of this topic arises particularity from a practical perspective as it allows for effective implementation with speed and the necessary protection in some judicial police tasks
Moreover specific laws addressing fight against corruption and the prevention of abuse or misuse of authority have been introduced. These laws ensure that practical actions taken in the field remain within the boundaries of legal procedures or grantees provided to protect individuals’ rights freedoms within society.
